The ground rules

1. Agreement

These Terms of Use ("Terms") are a contract between you and Benjamin Bayel ("we", "us") governing your use of the Ascent iOS application (the "App"). By downloading or using the App you accept these Terms. Apple's standard Licensed Application End User License Agreement also applies to your download from the App Store.

2. The service

Ascent offers a timed cognitive assessment and daily brain-training games. Some features are free; others require a paid subscription ("Premium").

Entertainment only. Scores, percentiles and "IQ" values produced by the App are estimates generated for entertainment and self-improvement. They are not a clinically validated IQ measurement, not a medical, psychological or educational diagnosis, and must not be relied on for any professional, academic or employment decision.

3. Subscriptions & billing

Premium is offered as auto-renewing subscriptions (e.g. weekly, monthly, yearly), some with a free trial. Prices are shown in the App before you buy.
Payment is charged to your Apple ID; we never receive your card details.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Any unused free-trial portion is forfeited when you purchase a subscription.
Manage or cancel anytime: iPhone Settings → your name → Subscriptions. Deleting the App does not cancel a subscription.
Refunds are handled by Apple under App Store rules (reportaproblem.apple.com).
EU consumers: by starting the trial or subscription you request immediate access to digital content and acknowledge that, once delivery has begun, the statutory 14-day withdrawal right no longer applies; Apple's refund process remains available.

4. Your use of the App

You agree not to abuse the service — including attempting to disrupt or overload our systems, reverse-engineer scoring, scrape or resell content, or use the App unlawfully. The App requires iOS 16 or later and, for sync, an internet connection.

5. Your data

How we handle personal data is described in our Privacy Policy, which forms part of these Terms.

6. Intellectual property

The App, including its design, games, question content, sounds and branding, is our property or licensed to us and is protected by law. We grant you a personal, non-exclusive, non-transferable licence to use the App on Apple devices you own or control.

7. Disclaimers & liability

The App is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties and are not liable for indirect or consequential damages; our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, and nothing affects the statutory rights of consumers, including under French and EU consumer law.

8. Termination

You may stop using the App at any time. We may suspend or terminate access for breach of these Terms. Sections 5–9 survive termination.

9. Governing law

These Terms are governed by French law. Disputes belong to the competent courts of France, without prejudice to mandatory consumer protections in your country of residence. EU consumers may also use the European Commission's online dispute resolution platform.
